Senior New Member Rest of 2024 Membership

An individual senior membership for a new (not having an active MFC membership since April 2024) member at Monte Fitness Center.  This is an online payment option.  You will recieve an email with instructions on how to complete the set up of your membership.
 
ASSUMPTION OF RISK AND LIABILITY WAIVER AND RELEASE:
I understand that exercise by its nature can be dangerous and cause injury, even death.  I know from multiple sources that before engaging in any exercise I should first discuss the proposed exercise program with a physician to confirm that I am medically able to engage in exercise without the threat of injury or death.  I understand that MFC has no way of knowing if I have consulted with a physician nor does MFC have the ability to force me to do so.  Therefore, it must be understood that by accepting a Membership and using MFC’s facilities I agree to assume all of the risk of injury or death arising out of activities on or about MFC’s premises.  I also understand that other people will be using the equipment around me and that these people may accidentally or intentionally conduct themselves in a manner that could be dangerous to me if I am not careful.  I realize that MFC cannot eliminate all risks of injuries on the premises and that therefore I must assume the risk of injury from other persons on or about the MFC property.  Furthermore, when people get together in groups and exercise there will always be bacteria, viruses and other health threats which cannot be completely eliminated by MFC.  
With these disclosures in mind I agree to fully assume the responsibility for the above described risks including others that I may not anticipate but may occur upon the premises and hereby release and hold harmless MFC, its owners, employees and any other person who may be liable by virtue of their relationship to MFC.  Consistent with this assumption and release I waive any claim or demands based on or account of any injury (physical or mental) or death or property damage, including theft, sustained by me whether caused by the negligence of MFC or otherwise.  Examples of released claims would include but not be limited to alleged improper maintenance of equipment, grounds or facilities; alleged negligence in instruction or supervision including personal training or inadequate security or staffing; slipping or tripping anywhere about the club or being assaulted by any Member or other person, not an Owner or Staff, while on or about the premises.  I expressly agree that the foregoing release and waiver of liability and indemnification agreement is intended to be as broad and inclusive as permitted by the laws of the State of Washington and that if any portion of this release is held invalid then the balance shall continue in full force and effect.  I understand that by signing this waiver and release I am giving up valuable rights.  If I am signing this on behalf of another person either as their parent or guardian, I represents that I have the actual authority to do so.
